Party Wall Disputes

Party walls are the walls / fences erected on the boundary to two properties which serve both properties. 

They can be found in both residential and commercial properties and disputes often arise when one side of the wall undertakes work which affects the party wall.

The Party Wall Act 1996 governs party walls and what procedure must be followed should works be done to or near the party wall.  A surveyor is usually instructed by both parties to reach an agreement prior to works being undertaken, however on many occasions this does not happen and damage to property occurs, causing a dispute.
