Dilapidation Claims

Landlord and tenants of both commercial and residential properties will need to consider their repairing obligations in accordance with their leases.  Any breaches of the repairing obligation could lead to a dilapidations claim.

A dilapidations schedule or inventory of disrepair is usually prepared and this will allow both parties to consider how they wish to move forward, whether through Alternative Dispute Resolution or court proceedings.

Landlords and tenants tend to have differing views as to their obligations and levels of disrepair which is why disputes arise.  We are able to advise both landlords and tenants on these matters together with other issues that may have caused the dilapidation claim such as service charge issues, lease renewals, expiry of leases and break clauses.
