Stuart has substantial experience of assisting clients with a full range of employment law issues and joined Dutton Gregory after having worked for two other large regional law firms.
He advises businesses and individuals in all areas of employment law but has particular experience dealing with Employment Tribunal litigation involving unfair dismissals, complex discrimination claims and claims involving whistle blowing.
Stuart also regularly advises both businesses and employees on a range of employment law related matters from day to day issues involving disciplinary matters, grievances, contract variations, restructuring and redundancies through to large scale collective redundancies, high court injunctive relief for breach of post termination restrictive covenants and business transfers containing complex TUPE issues.
He has provided employment law assistance in a range of transactions where businesses have been transferred and also provided TUPE advice in a number of complicated matters involving the sale and purchase of companies in insolvency situations.
Stuart has extensive experience in advising upon, drafting and negotiating severance packages and settlement agreements at all levels from junior staff up to senior level board members of nationally recognised companies and PLC’s
Stuart has experience of litigating in the High Court, including high value breach of contract claims, contentious probate and negligent misstatement. In particular Stuart successfully represented a claimant who was awarded in excess of £180k following a negligent reference in a case which also included obtaining Court ordered disclosure from Special Branch concerning investigations into terrorism in a Public Interest Immunity hearing.
In addition, Stuart regularly advises businesses and individuals in relation to post termination restrictions and restrictive covenants and has acted for both employees and employers in negotiating undertakings and, when needed, seeking and defending Court applications for injunctions.
Stuart has also assisted a number of businesses based outside the UK when litigating in the English Courts and Tribunal systems and has litigated on a range of disputes in the County Court including partnership disputes, breach of contract claims, commercial debt recovery, professional negligence and construction claims. Stuart has represented parties in negotiating settlements and exit agreements in employment matters up to £7.5 million and achieved settlements in fatal road traffic accidents of up to £1million.
