Leasehold Enfranchisement

This is also known as Collective Enfranchisement under the Commonhold and Leasehold Reform Act 2002.  It allows qualifying leases of qualifying flats the right to acquire the freehold of their building.

This is usually considered when disputes arise with landlords about the service charge demands, as the responsibility for the building will become the tenants.

There is a complex procedure required for this process and issues may also arise if the property has recently been sold and the tenants were not offered the right of first refusal.

We are able to provide advice to either landlords or tenants in relation to Leasehold Enfranchisement together with possible right of first refusal problems.  If you have any questions or require advice please do not hesitate to contact a member of our team.
