Clinical Negligence

Medical negligence or clinical negligence occurs where there is a failure by a doctor, or any other healthcare professional, to provide an appropriate standard of treatment which results in an injury to a patient.

Medical mistakes can vary hugely from a failure to diagnose a fracture through to an injury at birth which has caused severe brain damage.  However, for any medical compensation claim to succeed, it is necessary to prove that:

  1. The doctor or other healthcare professional owed a duty of care;
  2. The doctor or other healthcare professional breached that duty of care;
  3. The breach of duty caused harm; and
  4. Damage or other losses have resulted from that harm.

These legal tests can often be very complex, which is why it is crucial that a specialist clinical negligence solicitors firm is instructed to investigate a claim of this nature.

Dutton Gregory is one of the largest clinical negligence law firms on the south coast, encompassing both AvMA (Action against Medical Accidents) and Law Society Panel members.  Every year our specialist medical negligence solicitors recover millions in compensation for clients across the country.  We are able to offer many different types of funding, including Legal Aid and No Win No Fee agreements.  We also act for many clients who have Legal Expenses Insurance that cover medical negligence claims.
