The Employment Rights (Increase of Limits) Order 2010 details the maximum amounts of compensation employment tribunals can award, which change annually in line with inflation. The Order was laid before Parliament on 10 December 2010 and applies where the appropriate date falls on or after 1 February 2011.
The main changes are:
- the maximum compensatory award for unfair dismissal increases from £65,300 to £68,400;
- the limit on the amount of guarantee payment payable to an employee in respect of any day increases from £21.20 to £22.20;
- the minimum amount of compensation where an individual is found to have been unlawfully excluded or expelled from a trade union increases from £7,200 to £7,600; and
- the maximum amount of a week’s pay for the purpose of calculating a redundancy payment or for various awards including the basic or additional award of compensation for unfair dismissal increases from £380 to £400.
The amount a tribunal can award in discrimination cases is unlimited.
